Air Europa Strike Compensation

Air Europa strike compensation in Europe.

Are you qualified for it? How much is the compensation? What regulations apply?

A significant number of travellers are uninformed that strikes aren’t always classified as extraordinary events. If the strike occurs among Air Europa employees and results in postponed or cancelled flights, customers may be able to claim flight compensation from Air Europa. This is applicable to all Air Europa flights to and from Europe. Alongside this, passengers have the right to receive assistance.

There are two best options – you have the option to pursue this claim independently or collaborate with a flight compensation company.

1. Air Europa Strike Compensation

The criteria for eligibility for Air Europa strike compensation are quite clear.

Your flight should be either delayed or cancelled:

  • The flight delay must be a minimum of 3 hours, counted from the time the aircraft doors open at the destination, permitting passengers to disembark. If the delay surpasses 3 hours beyond the planned arrival time, passengers may be eligible for flight delay compensation.
  • Flight cancellations need to be last-minute. This includes all Air Europa flights cancelled within 14 days prior to the departure date. Passengers may be eligible for Air Europa flight cancellation compensation (not only Air Europa refund for cancellation) in all these scenarios.

Will you miss a connecting flight because of a delay or cancellation?

Air Europa is obligated to provide a complimentary replacement flight to facilitate passengers to reach their intended destination. This is a binding obligation. All airlines operating in Europe must adhere to the same regulations. The rules for compensation are the same as for flight delays. You’ll need to see how much later you reached your destination compared to your original arrival time.

Fundamentally, this is not specific compensation for Air Europa strikes (as such compensations are not recognised in Europe), but compensation for delays or cancellations.

These regulations are applicable to all Air Europa flights to, within, and from Europe.

By Europe and EU here on this page (and on this website in general) we mean all EU Member States, the United Kingdom (UK), Guadeloupe, French Guiana, Martinique, Reunion, Mayotte, Saint Martin (French Antilles), the Azores, Madeira, the Canary Islands, Iceland, Norway, and Switzerland.

1.1 Extraordinary Circumstances

Bear in mind that actions by airline staff do not fall under extraordinary circumstances.

Similarly, mechanical faults and inadequate staffing are not deemed extraordinary circumstances either, when it comes to flight compensation rules in Europe.

Nonetheless, some airlines may conveniently label a delay or cancellation as an extraordinary case, even when it clearly isn’t. In such instances, it is highly recommended to reach out to the airline for a clear explanation of a flight delay or cancellation.

Airlines could possibly state that a disruption was a result of extraordinary circumstances, despite it not being the case, to avoid providing compensation. This is due to airlines favouring extraordinary circumstances as it clears them from the responsibility of compensating anything. Therefore, it is wise to double-check any information provided by the airline before accepting it. Especially when it comes to flight compensations and flight refunds.

1.2 Right to Care

In case you end up waiting beyond your scheduled time, you are entitled to a right to care.

This grants you right to certain complimentary services. For instance, if your wait time at the airport exceeds three hours, you may be entitled to a complimentary meal and beverage. Moreover, if the delay exceeds three hours during the night, you might qualify for a complimentary hotel stay and transportation to and from the airport.

As per the law, Air Europa is obligated to offer these services to passengers based on the length of their delay. If you don’t receive any assistance, please approach Air Europa representatives at the airport.

2. How to Claim Air Europa Strike Compensation?

There are two methods available to apply for EU flight compensation.

You can do it on your own. From start to end. Air Europa strike compensation can be claimed individually. Go to their official site and request compensation by contacting their customer service. However, be prepared that this route may extend over several months and might require negotiations to bring forth a suitable resolution.

Alternatively, you can opt for legal assistance.

2.1 How Much Time Does It Require?

How long does the whole process takes in Europe?

It’s common for the process to span for around 2-3 months. Since 2021, we have heard of numerous cases where the duration has stretched further, predominantly when the claim is submitted individually (not by a law firm) and the airline decides to reject your request.

The process is not fast, so take this into account.

3.1 Air Europa Voucher Refund or Cash?

It’s not uncommon for airlines to offer vouchers as a form of compensation.

Offering vouchers is more cost-effective for airlines than giving cash refunds or compensation.

Nonetheless, passengers retain the right to reject the voucher and demand a refund in cash or by bank transfer instead. As per EU law, airline compensation and refunds should be paid in cash or bank transfer, so always insist on your right to receive your compensation in this manner.
