Air Europa Denied Boarding Compensation

How much is flight overbooking compensation? Rules? How to get it?

According to the EC Regulation 261/2001, you are entitled to denied boarding compensation from Air Europa if your Air Europa flight is overbooked, and you are denied boarding involuntarily. If you arrive at the airport only to find out that the airline has sold more ticket than there are seats, and you are denied boarding — you are protected. You will have a right to receive care from the airline, and in certain situations, to EU denied boarding compensation.

There are two ways you can claim this compensation.

1. Air Europa Overbooking Compensation: EU Denied Boarding Regulations

When it comes to denied boarding due to overbooking, the rules are extremely simple – you have a right to receive care and, in some cases, denied boarding compensation from Air Europa.

If you’re flying to or from Europe with Air Europa, and you are denied boarding involuntarily due to overbooking — you will be entitled to flight overbooking compensation (EU denied boarding compensation) up to €600.

This only applies to overbookings.

If you are denied boarding due to issues with your visa or passport, or if you been denied boarding voluntarily, you won’t be entitled to denied boarding compensation from Air Europa.

1.1 Voluntary Denied Boarding

What is voluntary denied boarding?

Yes, there are different types of denied boarding. 

First things first — what do we understand with the term “overbooking”? What is overbooking? According to the definition, overbooking means that an airline has accepted more bookings for a particular flight than there is room for. Overbooking is a common practice in the aviation industry. Flights are overbooked to avoid empty seats at take-off and maximize flight capacity in case of no-shows.

But there are situations when all people show up for their flight. It results in denied boarding. At first, the airline looks for volunteers who will give up their seats voluntarily. These volunteers are offered a new flight and some perks like free meals, instant compensation (cash or vouchers) and, in case of a long delay, free hotel stay. 

If you you accept such offer, it’s called voluntary boarding denial.

In this case, you aren’t entitled to denied boarding compensation from Air Europa.

You don’t have to agree to an offer like this.

1.2 Involuntary Denied Boarding

There are situations when passengers don’t have a choice.

For example, there are not enough volunteers. In such a situation, people with confirmed tickets might be refused boarding. If that’s what has happened to you, know that it’s called involuntarily denied boarding.

You can get denied boarding compensation.

What happens in case of involuntary denied boarding?

  • The airline must provide you with a new flight or give you a full refund for the flight;
  • In addition to that, you are entitled to receive care from the airline*;
  • You are entitled to compensation up to €600 per passenger. 

* Air Europa must offer you free meals and drinks in a reasonable relation to the waiting time, two free phone calls, e-mails or faxes. If you have to wait overnight, Air Europa must provide you with free accommodation and free transfer from and to the airport.

1.3 Right to Care

All passengers travelling with Air Europa have a right to care.

If you are stranded at the airport, waiting for your Air Europa delayed flight to depart, you are entitled to receive care from the airline. The same applies to Air Europa cancelled and overbooked flights. As long as you have to wait 3 hours or more, you are entitled to receive certain services from Air Europa (for free).

What does it mean for you as a passenger?

Air Europa must offer you free meals and drinks in a reasonable relation to the waiting time, two free phone calls, e-mails or faxes. If your flight is on the next day, you are entitled to a free hotel stay and free transfer.

2. How to Claim Air Europa Flight Compensation? How to Claim Flight Overbooking Compensation?

2.1 How Long Does It Take?

Each case is different.

For some people it might take 2-3 months, for some more.

It depends on the airline and on each individual case. If the airline doesn’t want to cooperate, you will need to take additional steps to get compensation.

3. How Much Can You Claim?

In the EU compensation amounts are fixed.

In most situations they range from €250 to €600.

Here is how you can calculate Air Europa compensation yourself:

When your destination is within the EU/UK:

If the distance of your flight is
up to 1500 km

€400

If the distance of your flight is between 1500 – 3500 km

When your destination is outside the EU/UK:

€250

If the distance of your flight is
up to 1500 km

If you are claiming compensation on your own, these are the amounts you need to ask for. Otherwise, you might end with a smaller compensation.

There’s one exception. When the flight distance is 3500+ kilometres and you reach your destination 3 to 4 hours later than planned, you are entitled only to 50% of the compensation amount (that means €300, not €600).

3.1 Air Europa Voucher Code, Discounts or Cash?

According to the law, compensations have to be paid in cash or by bank transfer.

Cash or bank transfer. Not vouchers, coupons, miles or discounts.

Air Europa, just like most airlines, may initially offer you a voucher refund instead of money. Request a bank transfer. Because all airline compensations and refunds in the EU have to be paid in cash or by bank transfer.

Air Europa Denied Boarding Compensation: FAQ

Can I get compensation even if my flight was very cheap?

Yes.

The price of your ticket doesn’t matter. If your flight was disrupted by the fault of the airline, and you arrived 3+ hours later than scheduled, you might be able to get compensation. Even if your flight was cheap. The price of your ticket doesn’t lower your chances of getting compensation. It also doesn’t affect the compensation amount. 

I don’t have travel insurance. Can I get compensation?

Yes, absolutely.

You can claim compensation even if you don’t have insurance. 

The fact that you don’t have insurance won’t affect your chances of getting it.

Can my child get compensation from Air Europa?

Yes.

If your flight is eligible to compensation, both you and your child can get compensation. Even if your child is an infant travelling on a special infant ticket. 

If you are entitled to €600, your child/baby will be too.

Can I claim compensation for another person?

Yes, you can.

You can claim compensation for your friend, relative or family member. 

They will need to: 

  • Provide you a boarding pass;
  • Provide you a passport copy;
  • Provide you information about their flight;
  • Sign documents the claim compensation company or airline will ask to sign.
How far back can I claim compensation?

It depends on the laws of the country.

In many European countries, you can claim compensation even for old flights. If your disrupted flight was 2-3 years ago, you still might get compensation for it. However, for the best results, we would recommend you to make a claim as soon as you return from your trip.

What to do if Air Europa is refusing to pay compensation?

Air Europa is refusing to pay compensation even though you are entitled to it. 

Don’t worry. You can still get compensation. There are two ways how you can proceed. 

The best way is to hand over your case to a flight compensation company. They will continue the work on your behalf. Alternatively, you may contact the respective national enforcement body and ask them to help solve your case. There are national enforcement bodies in all the EU Member states.

Problems With Visa or Passport

I was denied boarding due to issues with my visa / passport. Can I get compensation in such cases?

No.

It was your fault you were denied boarding.

The airline won’t compensate you for that.

EU – Non-EU Flights, Regulation UK261, Tourists

I’m flying to the EU from a country outside the EU. Can I get compensation?

If you’re flying with Air Europa then yes, you can.

When your Air Europa flight is departing from a country outside the EU (including the UK), you are still protected under the EU law (EU Flight Compensation Regulation 261/2004).

I’m flying from the EU to a country outside the EU. Can I get compensation?

If you’re flying with Air Europa then yes, you can.

All Air Europa flights are covered by the European regulation.

I am not a citizen of the EU. Can I get compensation?

Yes. 

The EU Regulation 261/2004 protects all passengers. 

I doesn’t matter what is your nationality.

Other Situations

Air Europa provided me with a free hotel stay and a free flight to my destination. Can I still get compensated?

Yes. 

You are entitled to both right to care and a new flight to your destination. If your flight is eligible to compensation, in addition to all of that, you are entitled to compensation.

Air Europa took me to my destination. Can I still get compensation?

You might.

If you arrived at least 3 hours later than scheduled, and the delay was due to the fault of the airline, you might get compensation. Accepting the replacement flight doesn’t lower your chances of getting compensation.
