As per EU regulation 261/2004, airlines are exempted from paying out flight compensation when the disruption is due to extraordinary circumstances. The extraordinary circumstances encompass severe weather, political and civil instability, and hidden manufacturing defects. Indeed, only hidden manufacturing defects are considered extraordinary circumstances. Most technical issues are considered the airline’s fault (the airline’s responsibility). Same like staff strikes, which are also regarded as the airline’s fault.

Moreover, bad weather is not always an extraordinary circumstance. Sometimes the weather is predictable. Example — snow during winter months (unless snow is infrequent there). In such instances, the airline is expected to implement appropriate measures to operate the flight punctually.

When Can You Get Flight Compensation From Air Europa?

There are a variety of circumstances that may enable you to claim flight compensation.

3. Denied Boarding Due to Overbooking
